Ankara Agreement 1963

The Agreement establishing an Association between the Republic of Turkey and the European Economic Community (commonly known as the Ankara Agreement) (Turkish: Ankara Anlaşması) is a treaty signed in 1963 that establishes the framework for cooperation between Turkey and the European Union (EU). The conditions for the application of the provisions of this Agreement in other areas to those territories shall be determined subsequently by agreement between the Parties. The Ankara Agreement was signed in Ankara on September 12, 1963. [2] The Agreement launched a three-stage process of creating a customs union to ensure Turkey`s full membership of the EEC. Once established, the customs union would begin to integrate the economic and trade policies that the EEC deemed necessary. This cooperation was implemented within the framework of an “association agreement”, called the Ankara Agreement, which was signed on 12 September 1963. An important element of this plan was the creation of a “customs union” so that Turkey could trade goods and agricultural products with EC countries without restrictions. 2. This phase shall last a maximum of twelve years, subject to derogations which may be made by mutual agreement. Derogations shall not preclude the definitive establishment of the customs union within a reasonable time.

Turkey first applied to become an associate member of the European Economic Community (EEC) in July 1959, after the creation of the EEC in 1958. The EEC reacted by proposing the creation of a transitional association to the full accession measure. This led to negotiations that led to the Ankara Agreement on September 12, 1963. [1] Part of the agreement was to consist of EEC financial assistance to Turkey, including loans of ECU 175 million for the period 1963-1970. The results have been mixed; EEC trade concessions to Turkey in the form of tariff quotas proved less effective than hoped, but the EEC`s share of Turkish imports increased significantly during this period [ 4. The Parties shall take all appropriate general or specific measures to ensure compliance with the obligations arising from this Agreement. 4. Where the dispute cannot be settled in accordance with paragraph 2, the Association Council shall determine, in accordance with Article 8, the modalities of arbitration or any other judicial proceedings to which the Parties may have recourse during the transitional and final phase of this Agreement. 1.

The Contracting Parties may refer to the Association Council any dispute concerning the application or interpretation of this Agreement concerning the Community, a Member State of the Community or Turkey. 2. In order to achieve the objectives referred to in paragraph 1, a customs union shall be progressively established in accordance with Articles 3, 4 and 5. . In accordance with Article 6(1) of Decision No 1/80 of the Association Council, Turkish nationals who are lawfully employed in a Member State of the EEC for a specified period shall be granted the right to remain in that State or to change jobs[8] This Agreement establishes an association between the European Economic Community and Turkey Article 2. The Contracting Parties recognise that, within the scope of this Agreement and without prejudice to any specific provisions which may be adopted pursuant to Article 8, any discrimination on grounds of nationality shall be prohibited in accordance with the principle set out in Article 7 of the Treaty establishing the Community. – the prohibition of import duties between the Member States of the Community and Turkey, and exports and all charges having equivalent effect, quantitative restrictions and any other measure having equivalent effect aimed at protecting domestic production in a manner contrary to the objectives of this Agreement; 2004 On 17 December, the European Council decides to open accession negotiations with Turkey. 2. The Agreement shall also apply to the French overseas departments in so far as it concerns the areas listed in the first subparagraph of Article 227(2) of the Treaty establishing the Community. 1996 The customs union between Turkey and the EU enters into force on 1 January.
